Check about:config if mailnews.emptyTrash is set to "True", change it to
"False".
AND be careful of what you're doing.
Should be mailnews.emptyTrash.dontAskAgain

That did it. (And yup, I know, playing around in there "voids my
warranty" :-)

from Netscape 4.7 till now, been using this stuff, and I never even knew
there was an Empty Trash option.
