Stuart. So have you set correct z-index options for your layers? Your menu item DIV(s) need to have a higher z-index than your Flash content in order to appear above (this is the case for any layered content, not just Flash).
Also, as the flash is below the other content, is there any need to wmode=transparent? If the flash content is the lowest layer, you should use wmode=opaque instead.
