And IMNSHO, portscanning does not constitute any kind of attack. Just go ahead; we do it too (of course, it is to say, that we most probably don't portscan whole nets. But then again, we might as well ;)). Portscan is merely like looking at a house _whether_ it has doors, and not like an attempt to open one of those.
