I've received the information on the new B�PF lawful interception tariffs
last week.

The changes are drastic but *not* to our disadvantage.  There are only
two tariffs now.  One is for requests of past data from log files and it
is CHF 538.- flat (IP Address, Login number, Email Log). The other one
is CHF 1'326.- flat for real-time transmission of Email messages. Gone
is the difference between the setup of a interception and the daily fee.

The new tarif model is far easier to get but since it is always a flat
rate no matter how long the interception (or logs, up to 6 month) is
I suspect that law enforcement will always opt for maximum period just
in case. So before they might have chosen 3 month or 1 month but with
the new model it doesn't matter if they take 6 month right away.

The only sad thing is how this new tariff has been publicised (actually
not). It was scheduled for Requests For Comments in Q4/2003 but it was
not made public on the official federal government web sites where all
other RFC are pulished. I sent a request to UVEK about this and got an
answer a few days later. They told me they had just circulated it among
some important ISPs and Telcos in Switzerland and those liked it, so
there was no need to get more people involved. I am a little bit disturbed
by this because this not really how things are supposed to be. Although
it might have been legal in the technical sense it gives the feeling of
letting something slip through undetected under the radar. In this case
it wasn't bad but what when there is something that has a negative effect
on us? I requested that SWINOG gets a email when any such new things are
under way so every ISP is informed, not just the big ones.
