Can anyone help me out with a small question? 

I am wondering how currently the law in switzerland is
for used domains. As I know, the law in america, is
following: If the domain name includes a "registered" product
name or company name in USA then the company may gain
the domain. 

How is the law in switzerland for that? 

For example.... 

There is a company called Rosch AG, they have an url, 
www.rosch.com ... their product has the name "Rosch"
and is registered worldwide(patent also). Now, someone
who is selling another product is registering www.rosch.ch
and saying that the company "Rosch" do not sell their products
anymore. Now on that page he offers "other" products for replacements
of the Rosch products. 

Does Rosch AG have the ability to gain the domain www.rosch.ch
or at least shut it down since the owner of the page is writing bullshit
and does impersonate with the other companys name?

(Rosch AG is just an example... I do not know if that one exist.. hehe)
