Abstract:
In this paper I will attempt to demonstrate that none of the
predominant accounts of political legitimacy can provide normative
justification of the political authority that contemporary settler
states exert over indigenous populations. I argue that examining
political legitimacy through the lens of indigenous governance claims
highlights two difficulties with these accounts: (1) all questions of
legitimate authority are viewed as synonymous with questions of
legitimate states and (2) the impact of normative plurality on
accounts of political legitimacy is ignored. Nevertheless, I argue
despite the unsatisfactory nature of the dominant accounts of
political legitimacy, it is necessary to resist philosophical
anarchism and retain some way to differentiate more legitimate
political authorities from the less legitimate. Lastly, I will
gesture towards an agonistic dialogical approach to legitimacy as a
potentially new way to view political legitimacy in the wake of
indigenous governance claims.
