From: Ben Golder Sent: Monday, 20 September 2010 9:00 AM To: [email protected]; [email protected]; [email protected]; '[email protected]' Cc: 'Kevin Walton'; '[email protected]' Subject: Public Law and Legal Theory Seminar Series: Dr Kevin Walton on 'Authority without Legitimacy' Importance: High Dear colleagues, I am pleased to invite everyone to the next in the Gilbert + Tobin Centre's series of 'Public Law and Legal Theory' seminars. The seminar will be given by Dr Kevin Walton of the University of Sydney. Kevin will be presenting a paper entitled 'Law and Orders: Authority without Legitimacy' (abstract and bio below). A full program for the series is attached. The seminar will be from 1.00-2.00pm in the Staff Common Room (Level 2) of the Faculty of Law, UNSW. There will be a lunch provided for attendees to the seminar. Abstract Many people say that the law has authority (and so must be obeyed). Most of them add that the law's authority is legitimate (and so obedience is justified). I examine these two statements by considering the conception of authority that dominates contemporary jurisprudence. According to this account, a philosopher cannot understand the first of the two statements without comprehending the second. It makes sense of authority in terms of legitimacy. I reject this interpretation and suggest an alternative to it. I thus deny that a legal theorist must conceive of authority with reference to legitimacy. Bio Kevin Walton is a Lecturer in the Sydney Law School and the Director of the Julius Stone Institute of Jurisprudence at the University of Sydney. He teaches and researches in legal philosophy. Among his particular interests are the methodology of jurisprudence and the moral obligations of citizens.
