I've done that (and done entirely too much debugging) more times than I care to admit. I've got a branch up here [1] that checks for this and some other physical constraints on creating states, which I branched off the current arbitrary coupling pull request [2]. Once the coupling branch is merged (should be soon), I'll rebase this against master and submit it.
