It would be obvious that Jon doesn't smoke the stuff because, if he did, it would have shown up in his drug tests. After all that is something that is tested for. Now if he isn't using then that causes problems because either, it was planted on him, or he was intending to sell it. As was pointed out the charge would be more serious then.
