I believe that an amenity can be closed by "administrative" means (a set of rules for containers, maybe laws for other entities) as well as by a physical barrier (closed door for example). It is the same argument as for administrative restrictions on roads. For example an highway/freeway can be physically accessible for bikes, but it doesn't mean that it is legal (or a bright idea).
