you have to have rt turned on.
why don't you just write it as EL enabled?
the classes in jstl core package is great for it.

Subject: Non EL enabled tags

If I were to write a non EL-enabled tag of my own, would the following
work:

<myTag:something value="<%= request.getContextPath() %>" />

b/c I am getting the string literal in the tag.
