I think the former statement is probably true, they've been operating in a bubble for so long that they don't understand the copyright/licencing problems. Having to explain to someone *very* senior from the OS what OSM was last week, brought that idea home to me. Interestingly enough, they held a future planning/brainstorming session on friday. Its part of something they call "Terra Future", apparently the main outcome was: "Opening up the OS and integrating with and hosting OSM voted the best idea at Terra Future 2009."
