Yes they do provide data available under the Open Government Licence. See Owen's comment on:
http://data.gov.uk/data-requests/list-of-grade-i-and-ii-listed-buildings-in-england As for the tagging, "listed_status=Grade II" is in line with what others have used. A quick google shows that "website:heritage=<english heritage URL>" has been used instead of source so that we are linking to the EH page but not saying this is the source. Rob
