I don't think there is any reason not to use any of the NLS's out of copyright images.
and it's listed as one of the layers available on the wiki: http://wiki.openstreetmap.org/wiki/National_Library_of_Scotland I've been using the town plan layer in Edinburgh and the detailed plans for old bits of town are really lovely.
