After talking to some others involved and the talk-us@ discussion, it's reasonably clear that this is another of those cases where a path exists but the property owner or government doesn't allow access, and there's a well established way of tagging that: access=no, and I've tagged the paths accordingly.
If someone is unhappy with how access=no is rendered on a particular map or router, they should raise it on the issue tracker of that style or router profile. Complaints on a local list will not make it to the developers of most styles.
