I think the council data is public domain, as I distinctly recall on the West Sussex or Hampshire online ROW maps that it was "public domain information overlayed on copyrighted OS maps" or some statement to that effect. And if it isn't public domain, it really ought to be, as surely it's in both public and landowner interest to disseminate as widely as possible where the rights of way actually go.
