I would however suggest that we avoid the legal details where possible and try to just describe in plain english what the problem is. My reason for this is that I believe that we might be diverging from legal reality in some aspects but if we stick to the core questions we can't go wrong. If you don't mind I may rework you text back to the core non-legal question, and put the legal technicalities you refer to behind an 'ianal but' warning!
