I think MJ Ray's argument was that even *without* any action from the trade mark owner's part, use of the trademark by third parties without express permission might have run the danger of being a criminal act. I.e. he was saying that nobody was needed to "make it criminal" - that the simple grant of a trademark would be sufficient to do that. I can't believe he's right but I think that's what he said. I refuse to discuss whether or not you are a total idiot but it seems to me that the trademark application wasn't exactly a PR stunt and it is probably in the best interest of everyone involved to forget about it and move on ASAP!
