Don't know if it is content from the Wiki. Could just as well be content from the OSM book ;-) If you are of the opinion that the design must be released CC-BY-SA then write to them. Using the design without their permission just because you *think* that the design should be under a different license is probably not a good idea. They are nice people and they won't sue you but it isn't right.
