The scale was removed in this source code changeset: http://trac.openstreetmap.org/changeset/17641 Because of the following trac ticket: http://trac.openstreetmap.org/ticket/1704
In short, the scale does not give accurate measurement because it doesn't change with respect to the curent latitude of the map.
