You're asking if its legal to "use", but you mean, is it legal to *trace* from. Answer: no. Presumably the reason layers like that have been set up is to assist with orientation, context, comparison etc. But you shouldn't go any further than "Hmm, Yahoo is showing some streets in this area that OSM doesn't have.
