Not really a bug. This is because the cursor IS in an empty area and there is nothing to scroll! When you then type a character, the scroll bar appears. This is the nature of a "free cursor" editor which allows you to cursor even where there isn't already text. You can also see this by cursoring in empty space to the right; if you go over far enough and type a character you'll see a horizontal scroll bar appear.
This is actually a feature of a few high-end editors. I use Multi-Edit which has the ability to turn this on or off (they call it "restrict cursor"). However, ME always displays the scroll bar (even with no text) which makes it a bit less confusing than TB.
