Thanks, unfortunately.
1) won't work ... well it would work but I'm running a process within a
process that can't be run as root.
2) Had my hopes up to find I have no /dev/bpf
3) Yeah can't do that :(
Is there a way to make a user have the same privledges as root without
doing a sudo?

There are a number of options depending on your operating system:
1) Use sudo
2) If your OS uses /dev/bpf, grant said user write access to the device
3) Hack your kernel to not require root access to write raw frames
