Probably settles all the different pronouncements on house property,
deposits, membership fee recd, etc by various HC ,especially 1985 Calcutta
HC till July 2023 saturday club, and Delhi Gymkhana , stock exchanges etc ;
Clause of Mutuality was interpreted as court thought of. Reliance played a
great part in placing their money in the forms of property and deposits,
diverting their taxations. If this decision will make the AOP status
taxable ,well so many clubs will shut down faster. K Rajaram IRS 18 8 23

SC dismisses the batch of appeals preferred by various clubs challenging
the HC judgments in Secunderabad Club and Madras Gymkhana Club, among
others, holding the clubs liable to tax on interest earned from deposits
made with their corporate members; SC categorically holds that the
coordinate bench ruling in Bangalore Club holds the field and does not
require reconsideration despite the fact that the coordinate bench did not
consider the prior judgment in Cawnpore Club; SC observes that the Cawnpore
Club decision is not a precedent under Article 141 of the Constitution as
it did not declare any law on the principle of mutuality; SC relies on a
catena of domestic and foreign judgments to uphold the HC rulings and holds
the clubs liable to tax on such interest income like any other income from
other sources
The judgment was pronounced a while ago by the Division Bench of Supreme
Court comprising Justice B.V. Nagarathna and Justice Prashant Kumar Mishra

Senior Advocates Arvind P. Datar, Firoze B. Andhyarujina, Pritesh Kapur
along with Advocates M. P. Senthil Kumar, Pratap Venugopal and a battery of
lawyers appeared for the Assessees while the Revenue was represented by ASG
Balbir Singh, Senior Advocate Arijit Prasad along with Advocates Gargi
Khanna, Alka Agarwal, A. K. Kaul and others
