The Supreme Court has laid down an eight-point formula to decide the alimony amount amid the ongoing debate over Bengaluru-based techie Atul Subhash, who died by suicide due to harassment from his wife and in-laws for money. Before taking his own life, Atul Subhash, a Bihar native, recorded an 80-minute video accusing his estranged wife Nikita Singhania, and her family of extortion and harassment. He also penned a 24-page suicide note criticizing the justice system. According to a Live Law report, a top court bench comprising Justices Vikram Nath and Prasanna B Varale laid down the guidelines for deciding the final alimony amount in a divorce case involving a Hindu couple. The appellant (husband) and respondent (wife), remained married for six years and lived separately for nearly two decades. The husband claimed the wife was overly sensitive and distant from his family, while the wife alleged his mistreatment. Here are the eight factors listed by the Supreme Court to be considered when deciding on alimony. Status of the parties, social and financial. Reasonable needs of the wife and the dependent children. Parties’ individual qualifications and employment statuses. Independent income or assets owned by the applicant. Standard of life enjoyed by the wife in the matrimonial home. Any employment sacrifices made for the family responsibilities. Reasonable litigation costs for a non-working wife. A bench of Justices JK Maheshwari and Rajesh Bindal questioned whether the reason provided for canceling the pooja was valid, stating that the ritual is meant to honor the deity, not ease public crowds. Justice Maheshwari said, "This pooja is for the deity. The management can find ways to handle the crowd, but we need to examine if this reason is enough." The petitioners, members of the hereditary priestly family, had approached the Supreme Court after the Kerala High Court upheld the temple's decision. They argued that the Udayasthamana Pooja is an important tradition and that skipping it on Ekadasi would harm the temple's spiritual sanctity. The petitioners pointed out that the ritual, established by Adi Shankaracharya, should not be altered. The Guruvayur Devaswom, along with the temple's chief priest (Tantri), had defended the decision, saying that the ritual was not essential and could be changed to accommodate the crowd. Although the court couldn't intervene immediately since the pooja had already begun, it expressed support for the petitioners' case. The bench ordered that the temple's daily pooja schedule, as listed on the website, should remain unchanged. "We cannot intervene now. We will issue a notice to the other side. Prima facie we are satisfied," the bench said. Udayasthamana pooja refers to the various worship conducted in temples throughout the day from sunrise (udaya) to sunset (asthamana). The temple administration recently decided not to conduct the ritual on ekadasi, citing difficulties over crowd management and the desire to allow more devotees time for darshan. The Kerala High Court had earlier dismissed the case, saying that the Tantri had the final say on such decisions. The Supreme Court has now issued a notice to the temple management, the Kerala government, and the Tantri, and will hear the case in four weeks.
