A 1m check of the code make me think that you could just comment this assert and probaby another one later and that it would work.
So if you want to try it, it could be easy. If you do so and it work, it would be great to add this to Theano. But don't be surprised if you see other small problems like that, as Pascal told, we don't develop it for a while.
