Copyright (c) 2006 Wesley Berry, AAF Wesley Berry Flowers http://www.800wesleys.com/ If Jennifer Anniston looks in the phone book for the telephone number of a local florist, can she be sure she's really going to reach a flower shop in her town? Unfortunately, unless she's actually seen the shop, she can't. There's a growing trend in the world of flowers that has companies misrepresenting themselves as locally based companies. In fact, it's become such a problem that at least 20 states have passed laws prohibiting this shady business practice. Recently, Teleflorist, Inc. in Southampton, Pennsylvania (a company that is in no way affiliated with the Teleflora wire service) was ordered to make restitution to every individual residing in the state of Tennessee who ordered flowers through them. Under the ruling Teleflorist was required to pay each customer $40 because it had misrepresented itself as a local business in 39 cities in Tennessee-a practice that is illegal there. These payments will result in a total of $16,000 paid out to customers. In addition, the company must pay a fine of $13,000 to the state of Tennessee. Here's how it works: Jennifer Anniston decides she'd like to order flowers for a friend. She reaches for her phone book and looks up listings for flower shops. There are six of them listed for her town. She calls the first one and believes she's speaking to someone right there in her hometown who will design the flowers in their shop and deliver them to her friend. What has really happened is that after she dialed the seemingly local number, her call was-unbeknownst to her-redirected to a central 800 number for a company in another state who will fulfill the order...although it may not be done with the same care as a local florist would take. Some small, locally owned flower shops are really suffering from this situation. Florists have received calls or visits from irate people who believe they've placed a telephone order with the shop, but never received the order or received a substandard arrangement. They make this mistake because there is truly only one flower shop in town, so they're certain this must be the shop they've called or because the name of the existing flower shop is similar to the name of the false company in the phone book. So, how can you avoid falling prey to these misleading companies? Well, the most certain way is to visit your local florist to place your order. Face-to-face orders allow you to develop a relationship with your florist, express your needs, and see new products and designs. But, an in-person visit isn't always practical. Another good solution is to scope out the florists in your area and keep the phone number for your favorite shop on hand, rather than having to look it up in the phone book. Jennifer Anniston may never find herself the victim of such a questionable business practice if she only orders flowers from those florists she's familiar with. But, to be sure more people don't fall into this trap, it's important to see to it more states pass laws prohibiting misrepresentation of the location of a business. --------------------------------------------------------------------- Wesley Berry is member of the American Academy of Floriculture (AAF) and President of Wesley Berry Flowers (http://www.wesleyberryflowers.com), a successful multi-million dollar floral business that was established in 1946.
