The FF movies were not made by Marvel, while the "Cap" movie and the "Avengers" movie, etc, are. So his appearances as the Torch don't really count as "canon" for the new movies. Same with Jon Favreau playing Foggy Nelson in the "Daredevil" movie (not Marvel) and Happy Hogan in "Iron Man" (Marvel).
