I honestly don't know how Moore expected that story to not be in continuity. You can't do something that huge to a...well at the time she wasn't a major player in the Batverse but she was still a big supporting character. Anyway you can't shoot Batgirl and expect other writers and such to not pick that ball up and run with it. It wasn't like Dark Knight Returns which was set in the future. I think we ended up with a much stronger character but that is another topic for another day.
For the sake of argument I will say that if this is true and Moore's intention was to have Batman kill the Joker at the end I would ha e a better opinion of the story. While the background stuff with the Joker was very well done and compelling and again I think that the ending as it struck me was pretty bad. The Joker cripples Barbara and then tortures Gordon and at the end he and Batman have a good laugh? That rubbed me the wrong way in 1989 and continues to do so now. And I would have to go back and look but I thought the rain drops at the end mirrored the same image at the beginning. I will double check on this when I get home.
