The article makes mention of KS's requirement of having a prototype. Having never attempted to fund anything on KS (and only having backed a couple of games, Rob Kelly's superlative Ace Kilroy comic book, and Rifftrax projects), I do not know how stringent this requirement is, or whether it is mere boilerplate to which "Yes, we have a prototype" is an acceptable answer. Another interesting aspect is in one of the comments -- how much of the money pledged is from fake pledgers, there to drive up interest from legitimate pledgers and act as a sort of digital peer pressure? In any event, Jenn is right with the notion that KS has pointed to their TOS previously when projects have essentially stolen the funding raised. I seem to recall a comic or art project where, after funding, the project guy essentially said "Nah, I'm going to keep the money and not give out any of the promised rewards," and KS essentially just threw their hands up and said "Sucks to be you guys." That having been said, if the large amount of investors and dollar amounts here can act as a sort of leverage, if it really is a scam, maybe KS could be named in a class action suit against the project. I don't know the legalities of it, but given the nature of civil court, it seems like you can sue any party no matter how remotely connected to the incident they are. Overall, I think it would be a better idea to just back Rifftrax's latest project of riffing Godzilla '98 AND Anaconda in theaters.
