The drone operator claims he was shooting the scenery -- sorry, but you 
cannot "shoot the scenery" on privately owned property without permission, 
that is called trespass. 

I'm not in favor of destruction of property, but drone operators who think 
they can do whatever they want with their device just because it is not 
touching the ground is the rough equivalent of the "I'm not touching you" 
game. Landowners need some type of recourse to prevent this sort of 
activity other than shooting them out of the sky, as fun as that may be.

Ironically, right now in my neighborhood someone has posted some "Missing 
Drone" signs. No word on whether it went down by accident or through the 
application of firepower.
