Couldn't you just substitute "text" for "tags" to find tiddlers with
todo slices? As in:

<<forEachTiddler
 where
' tiddler.text.contains("todo") &&
! tiddler.tags.contains("systemConfig") &&
! tiddler.tags.contains("hide")  '
 write
  '"| [["+tiddler.title+"]] |<<tiddler [["+tiddler.title+"::todo]]\>\>
|\n"'

(or you could even look more specifically for ("|todo") ?)
