Not the rules, but the nature of the consequence of breaking the rules.
Knowing the students is one of a host of factors involved in arriving at a
decision. As the Romans, those innovators of written law, would say, the
law serves the people; the people do not serve the law. There is always a
face to a decision; always a "for instance;" always a set of singular
circumstance. Nothing is absolute or cut-and-dry. That is why the Roman
created the concept of modifying precedent in law.
