Its a slick concept, but the devil is in the details.
- Throttle relays
Who provides these? If its a small group of major companies, why
would they handle my mail for free? If its a widely distributed
collective of throttle operators, how do you certify who can become a
throttle-relay operator? Further, how do you disseminate the list in
a compatible way (gigantic DNS replies to MX queries wouldnt be
good).
The throttle relays part is a bad idea imo. The throttling can be
done by /any/ mail server, be they destination or transit MTAs -
there is no need for a cluster of throttle relays. This would require
addition of throttle functionality to all MTAs, however as otherwise
all MTAs would require the addition of throttle-discrimination
functionality, this isnt a big deal. (end result to the
'unaccountable' spammer is that their spam runs take ages to complete
either way).
Note that there already exists a system to detect and discriminate
high volume mass email from other email, the Distributed Checksum
Clearinghouse:

- Control/Criteria
Who decides the criteria by which an operator of an MTA can be judged
accountable?
What will the criteria be for membership of the whitelist? A legally
binding contract? Under what jurisdiction? If contracts, who pays for
the legal proceedings to pursue breaches of contract? If the
collective, does that imply a membership fee? And how much?
Who applies these criteria, and how are they applied, to operators of
MTAs who wish to join the whitelist?
etc..
I think the control/criteria part of operating such a whitelist would
not easy to sort out, never mind the operational aspects, eg actually
trying to hold members who are in breach accountable.
