Yes, but the idea is that these distinctions are unnecessary.  If the
message is confirmed/released, you don't need to look at in tmda-cgi.

Yes, as long as tmda-cgi has some way of knowing which messages are "actually pending" so only they are shown to the user. Otherwise it's not a list of pending messages but a list of messages which may or may not be pending, which is less useful in my opinion.
