Subject: Re: [TMIC] Disability Insurance Problems - update

I want to thank everyone for their support in my LTD problems.
I contacted the Disability Insurance lawyers that was mentioned on the GMA
and talked to Alycia. Alycia was very happy to inform me that since I
worked for the government, even if it was the county government, I am exempt
for the ERSIA laws which means what applies in ther ERSIA laws does not
apply to government employees. Therefore, I will may have to go thru a
review board - but probably not even that. BUT the best news is that any
lawyer fees, court costs or legal fees will be tacked on to the settlement.
Another thing is that in 90+% of the time, government employees win.
I am so feeling so much more positive.
Once again thank you all for your support.
Candy K.

Hi Candy,

I'm sorry you're having to go through this. I had worked at the same place
for 31 yrs when TM hit me in April 2002. I should not have tried to work at
all - it took it's toll on my body and I probably would have had a better
recovery if I hadn't been so stubborn. I cut back to 3 days a week, then 2,
then just had to "retire" My doctors told me to retire right from the
beginning. I did apply for SSD and knew I would be denied the first time.
Then I called an attorney firm in California that specialized in nothing but
getting the SSD through and the judge was ticked, to say the least, that my
file had even been presented to him. It was quite obvious that I could not
work. (but I wanted to and I really still miss my job) You might think this
is an odd question, but do you have to self-cath? I wonder just how many
employers are willing to hire someone who has to be in the bathroom half the
day, falls asleep at her desk and spends more time at doctor appts than at
the job. It really angers me that you should have to go through this. The
fatigue we have is quite enough, but add a full day at an office and all I
can see is our health going down hill.
My 2 cents
Linda

Subject: [TMIC] Disability Insurance Problems

Well today has really started off great. I received a check from my
independent disability insurance co. Staurday for 7-1-08 thru 7-4-08. When
I called, to find out why, the rep tells me that their review board has
decided that after 2 1/2 years that I could be doing working seditary work
in todays economy.
I stated that I had not gotten any info informing me of such. The rep
apolozied and said he would be sending a letter in the next day or two
explaining.
I told the rep that if they could find me a job where I could work 2 maybe 3
days a week for 2 or 3 hours at max and an employer who would allow me to
call, or not call because I'm totally exhusted and sleep thru an alarm, that
paid $25 to $30 an hour, then I'd give it a whirl. However, the jobs here
in Naples, FL are service oriented and the "better" paying jobs require you
to be up and mobile.
The rep stated one time that it was the review board doctor and then another
time that it was my doctor that stated I was fit to work in a seditary
position.
I see my doctor tomorrow and I guess I need to consult a lawyer. These
insurance companies are something else!
I'm so upset and yet I keep telling myself to calm down cause I know what
stress does to me and my condition.
Does anyone have any advise other than what I plan to do?
Prayers and thoughts for you and yours,
Candy K.
