thanks i'm checking my jars now; $JAVA_HOME/jre/lib/ext did not have the class and i will definitely check tools.jar and xercesImpl.jar.

Are you shure that that you don't have an jar file on your system that contains the w3c classes that might be found before xerces ? There might be other jar files that contain this classes.
