How firm is this requirement?   What's the rationale behind it?

Several people who have made similar surveys of bug tracking software
lately have suggested the best candidate they found was Jira [1], which
includes source, and is free to open source projects [2], but does not allow
free redistribution.   It's been adopted by a number of open source
communities already, most notably the Apache Foundation [3] and the
Roller blog hosting software used by blogs.sun.com.   Would that be
close enough to meet the underlying reasons for E0, or is E0 simply a
philosophical requirement?
