The conditions themselves are fairly restrictive but in practice Valve seems to be willing to bend them themselves. For instance the "No refunds" clause, in general they follow this, but they have been willing to review instances even on a case-by-case basis.
I know the terms themselves are the purpose of this site and that Valve's own willingness to waive their claimed rights in different cases does not change the fact that it is claimed.
