Is this really something related to the terms of service? It seems to be
just a technical feature. Although it is very important it does not seem
in scope with ToS;DR. (Moreover your point about encrypted
communications overlooks the fact that, from what I have seen, Whatsapp
keeps metadata logs, see

Let's not go into technical assessments unless it is directly linked to
the terms. For instance: does whatsapp undertake to only collect a
minimal information of data?
