Looks like the kind of problem that grabs are meant to solve.
Unfortunately the Unity8/Mir architecture does not support grabs right
now.

However there might be another solution involving focus tracking. Does
clicking on the main app window close the first context menu?

Bug description:
  ubuntu 17.04 unity8
  see attached screenshot 

  launch kate
  right click inside the window (doc tab) 
  open a menu from the title bar with the mouse (hover over the window title 
bar to reveal the menu, click on random menu entry, like Tools or Settings or 
whatever

  now you have 2 opened menus overlapping
