The bit rate is not irrelevant, the higher the bitrate (assuming it is
well encoded) the fewer people there are who in a blind test can tell
MP3 from the uncompressed original. Once you get to 256k there are very
few people who can tell the difference (except maybe on very carefully
selected bits of audio which thankfully don't represent the vast
majority of music that people listen to).

Of course when I can I stick to FLAC, even though I know I can't
distinguish it from high bitrate MP3. But that is because it just stops
me wondering if I'm hearing MP3 artefacts, even when I know I can't.
