My answers follow each question
(1) Once the Addenda is approved, will we have two years to implement the changes? The Secretary is required to give a minimum of 180 days to implement changes to the standards, and may give more depending on the complexity of the change. We will propose a 6 month implementation time frame for the addenda changes. (2) Once the Addenda is approved -- I believe this becomes part of the implementation guide. Does this mean the first one changes and is no longer valid(deprecated)or do we have two guides? As of the implementation date for the changes, the revised standards (with Addenda) become the HIPAA standards; and the previous ones are no longer the standard. (3) Do the Addenda changes fall into the following definition that Kepa mentions? "But, there is one exception. During the first year after adoption of any standards, the Secretary can change the standards "if necessary for implementation." After that initial course correction, the changes must be spaced at least one year apart. No, the initial standards were adopted as of October 2000. The one year period as passed. (4) If the Addenda is approved, does it become part of the implementation guide that we are required to implement on October 16, 2002/2003? The required implementation date for the addenda will be specified in the final rule adopting the addenda. I expect it will be no later than Oct 16, 2003.
