Laura,
I don't think the Federal Register language necessarily implies that all the 
previously proposed exceptions "telephone voice response, faxback, ..." have to now 
meet the data content portion of the standard. Federal Register states "...there are 
certain transmission modes..." and then goes on to talk about dumb terminals or 
computer browser screens (DDE) conforming to the data content portion of the standard. 
In addition, Q/A on the HHS site makes it clear that fax imaging and voice response 
transmissions are not subject to HIPAA transaction standards.
