Here's the relevant portion is in Section 3 of ASCA on this topic.
Sec. 3 requires electronic submission of Medicare claims
� Means that services submitted on paper claims shall be considered
non-covered
� The Secretary�
A) shall waive the application of subsection (a)(22) in cases in which�
(i) there is no method available for the submission of claims in an
electronic form; or
(ii) the entity submitting the claim is a small provider of services or
supplier
Provider of services: < 25 FTE�s
Other physicians, practitioners, facility or supplier
(other than provider of services): < 10 FTE�s
Thus, ASCA requires the electronic submission of all Medicare claims except
for the above conditions.

There was one interesting comment by CMS about the exemption from filing
electronically with CMS by Oct 2003. I understood CMS to say that if
you were not a CE and were a provider with less than 10 FTE or an
institution with less than 25 FTE you could still file paper claims with
Medicare.
