The State of WA workers comp is also trying to become HIPAA compliant
even though they are exempt although I heard about that before the big
state budget deficit was announced.

We actually are changing our systems to be HIPAA compliant; have had a
project going for some time and will be ready to test next April if not
sooner.   The department also sent in a request last year to get
national
codes for all our local codes that we could not crosswalk.  We believed
that
they would have been granted, but so far we have been totally ignored.
We
will continue to request national codes if a code does not exist that
meets
the business need for Workers Comp.  My point was that somehow the
testing
has to allow some local codes for those payers that are exempt,
otherwise
the providers may not receive the appropriate payment for services.   We
are
only one state out of 50 and I doubt that the majority of the exempt
payers
are even listening to this discussion.

The Consolidation Appropriations Act of 2001 extends the maintenance and
use of official HCPCS Level III procedures and modifier codes deadline
to Dec. 31, 2003.  CMS wants requests for temporary national codes,
including a justification as to why a temporary national code is needed,
by April 1, 20003.

I know that Workers Comp programs are small players in the transactions,
but
I need to remind the group that these programs are exempt from HIPAA and
can
use local codes.  So far the CMS has been reluctant to grant national
codes
for our local codes because of our exempt status.  There has to be
someway
for you to test local codes to make sure they are not all stripped from
the
data stream.

Yes,
to remove local codes is one of the main goals of HIPAA standardization.
Study the codes that are available and see if they don't cover your
situation. If not, you could theoretically ask the standards body for
new
codes to be authorized, but this is a lengthy process and I wouldn't
count
on it.

procedures in the SV1 segment.

We are in the process of testing 4010 and our certifying authority is
rejecting the local codes.
