Maybe try checking if the object is persisted in configure, first?
something like.

<cffunction name="configure" returntype="void" output="no" access="private">
    <cfscript>
           if ( getIsPersisted() ) {
               setConfirmAddress(getEmailAddress());
           } else {
              setConfirmAddress("");
           }
      </cfscript>
</cffunction>

I'm wondering if the incorrect behaviour happens for un-persisted
objects....
