Hello Amit Rainhartz

For Europe I may answer like this:

If your device is a radio transmitter (i.e. a Satellite interactive
terminal) or if the device is connected to a public telecom network it is
regulated by the R&TTE Directive and it has to comply with the essential
requirements defined in this directive for such products. These requirements
include EMC and electrical safety and are going beyond. Furthermore some
specific procedures have to be followed when putting these products on the
European market.

If your product is neither a radio transmitter nor a telecom terminal, then
it is simply an electronic device which has to comply at least with the
requirements of the EMC Directive and the Low Voltage Directive.

In Europe these regulations are coming from the European Commission and have
to be implemented into national law by the memebr states of the European
Union. Some of the European countries not belonging to the EU adopted these
regulations (i.e. Switzerland and Norway).

In case of further question don´t hesitate to contact me directly.

Betreff: Regulation of Interactive TV - Institutional question

Dear Friends,

I am looking for information regarding the regulation, in different
countries, of Interactive TV (on its various forms and services: interactive

games channels, t-commerce, etc.).

My question is focused on the regulatory structure rather than on the
substance of regulation.

I am interested in learning what is the regulatory body that regulates
interactive TV services - in the different countries with a dual regulatory
approach (i.e. separate regulatory bodies for broadcasting and
telecommunications). Does Interactive TV services (for example an
interactive games channel) fall under the definition of television
content/program, or any similar definition which grants regulatory powers to

the broadcasting regulator, or are enhanced interactive services considered
as telecom services and regulated by the telecom regulator? Are there any
overlapping regulation/regulatory powers? Any synergistic work between the
regulatory bodies?

Thanks in advance for your replies.
