Nick, John & Co, Just to confirm, according to the minutes from ACTE 41, the CTR 21 proposal was forwarded to the Council. This _never happend_ before which makes it quite hard to predict the schedule for the remaining process.
As far as I understand, the Council meeting later in May cannot take the process back on track again without considerable delay. Option 1 below would still require further changes to the proposal and it must go back to the Commision again before a formal CTR decision can be taken. It is unlikely that the same proposal will pass just by voting again. Remember that the TBR 21 voting did not include the foreword and all the controversy is about these matters (e.g. Germany got the transitional period changed from 12 to 15 months but it didn't help very much.......). Another crucial issue is the legal status of the Advisory Notes. Germany still want these to be mandatory. An advice about the acceptance of TBR 21 reports; if possible use an "appropriate" Notified Body. Some NBs do not accept reports from labs located in countries which do not use TBR 21 as alternate national standard, but other NBs in the same country don't have such restrictions (as long as you pay the bill). You also need to be careful where you get a TBR21 report from if you want to use it all of these countries. It is wise to check with the approval authorities in each case to see if you favourite lab will be accepted. As John Dunn indicated, we are expecting some more news in May about the ultimate designation of TBR21 as a CTR. I also agree with John that the word is the European Commission is determined, if necessary, to force through TBR21 as a CTR but I am unclear on the processes, procedures and legal basis they plan to use in this respect. At the moment, TBR21 is still following the formal procedures laid down for acceptance and designation of a technical standard under the scope of the TTE directive. If it fails to get through these procedures, if only be a slim margin, I don't know what kind of legal position the EC is in to force it through in its current format. Perhaps someone else can shed some light on this as nothing I have heard so far convinces me that the EC has a strong legal case for this but hopefully I am wrong. The latest information I have (from DTI in the UK) is that after the recent failure of ACTE to agree on CTR21, a European Council meeting will be held to consider the matter. This will happen in 2 or 3 weeks time. There are 3 possible outcomes: 1. If it passes this meeting, TBR21 will be back on track to become a CTR in the normal way. 2. If it fails unaminously, then it is in big trouble. 3. If it fails, but the the 'fail' decision was not unaminous, then the European Commision has the right (and rumor has it that they are determined to use it), to override any previous decisions, and force it through anyway. This could take some time, but if the European Commission wants to do this, then it is theoretically unstoppable (leaving political, behind-the-scenes horse trading aside). I am told the UK will be voting 'YES' in the forthcoming council meeting, so option 2 is out. So, it's a matter of waiting a few weeks to see whether CTR21 will be adopted by everyone soon, or whether the seemingly incessant wrangling will continue. Hope this helps.
