==In my opinion==

nobody gives a hoot how the device does its thing, as long as the device in
any state, does not harm the network.  Since voice service as such is
excluded from CTR21, member states may seek assurances that the device will
not harm their network when in any audio mode.  Anyone of the better
Notified Bodies will be able to help you on this issue as they have to sign
their "NB number" over to you.  Under the best of circumstances, I suspect,
you may have to do a hell of a lot of explaining in each member state.
